Loss Of Job Upheld As Exceptional Hardship
This was the third of three successful exceptional hardship proofs which we conducted on 1 November 2017 at Dumfries Justice of the Peace Court. It had been a very successful day however we were quickly brought back down to earth by the issue of a parking ticket. It really can ruin the best of days.
The exceptional hardship in this case solely fell upon the accused and these cases can be difficult to get over the line. Our client gave genuinely moving evidence about his situation and, in the words of the great Edgar Prais QC, the court was awash with tears. The loss of his job, coupled with the anticipated long term effects was enough to persuade the court that this was an exceptional case.
When it comes to exceptional hardship cases it is important to note that there are no hard and fast rules. We cannot stress enough that the success of an exceptional hardship proof depends upon preparation and presentation. Don’t be the guy in court with the lawyer fumbling about his file for a scrap of paper. With our firm we can guarantee your exceptional hardship case will be fully investigated, thoroughly prepared and presented to the court with skill and flair.
