We know the old saying was slightly different however this case serves as a good example of the difference legal representation can make, even when a case is at the latter stages. Our client in this particuar case contacted our office for legal advice having previously entered a plea of guilty to driving without insurance. The case appeared to be a special reasons scenario where the accused is essentially blameless for the lack of insurance having relied upon an assertion by the owner of the vehicle that the appropriate level of cover existed.

Following investigations we were in a position to obtain a letter of indemnity from the insurance company which essentially backdated cover to the date of the alleged offence. The Crown permitted the plea of guilty to be withdrawn in these circumstances and allowed a not guilty plea to be substituted therefore which was ultimately accepted by the Crown.

The accused was accordingly acquitted of the charge and was understandably delighted with the outcome.
