Drink Driving Special Reasons 5 Penalty Points

Our client was a passenger in his own vehicle and was awakened by his friend who was driving. An argument broke out and his friend brought the vehicle to a stop in the middle of a 4-way crossroads at 3am. Our client - who had been drinking - drove the vehicle a short distance and brought it to a stop.

The police pulled up, breathalysed him and found him to be over the limit.

Our Mr Simpson addressed the Court fully and invited the Sheriff to find that 'Special Reasons' had been established and that, in the circumstances, a disqualification was neither proportionate or necessary.

The Court took some days to consider the evidence and the case law and ultimately agreed that special reasons had been established. 

Our client retained his driving licence with was endorsed with 5 penalty points.

An outstanding result.
