Our client was accused of dangerous driving by performing an overtake when it was unsafe to do so. The incident was captured on dashcam and involved a very near miss. 

We had attempted to resolve the case at an early stage by offering to plead guilty to the statutory alternative of careless driving.

The case called for trial on 7th June 2024 and our Mr Simpson attended at Lanark Sheriff Court.

There were a couple of technicalities in the case. Following negotiations on the morning of the trial the Procurator Fiscal conceded defeat, and with considerable reluctance, accepted the previously offered charge of careless driving.

Following a plea-in-mitigation, the Sheriff endorsed our client's licence with 7 penalty points and imposed a reasonable fine.
