Dangerous Driving A9 101/70 Reduced To Careless 4 Points

Our client was accused of dangerous driving by driving at a grossly excessive speed past a layby and a junction whilst having consumed alcohol. The speed was detected at 101mph by a Prolaser 3 and he was stopped by the police at the time.

This was a delicate case and our client had to keep his driving licence for work. We were instructed in the case and a not guilty plea was entered. 

The evidence in the case pointed towards a standard of driving that was careless as opposed to dangerous.

We spoke to a senior prosecutor at Inverness and discussed the evidence in great detail. Following those negotiations the reference to alcohol was removed from the charge. Further, the charge was reduced from dangerous to careless driving, and a plea was tendered on that basis.

Our client did not require to attend Court for this case and written mitigation was provided on his behalf.

The written mitigation found favour with the Presiding Sheriff who endorsed our client's driving licence with 4 penalty points and fined him £400.

A fantastic outcome in circumstances where he originally faced a minimum 12 month disqualification.
