Client Retains Licence Elgin Dangerous Driving
This matter called for trial on 28 February 2020 within Elgin Sheriff Court. Our client had originally been charged with dangerous driving, contrary to s.2 of the Road Traffic Act 1988. The complaint libelled an allegation of driving at excessive speeds, failing to maintain lane discipline when negotiating bends and driving onto the opposing carriageway. Aside from the obligatory disqualification if convicted, our client was also subject to the new driver provisions which presented a further threat to his driving entitlement. Following four months of hard work the matter resolved by way of a plea to a reduced charge of careless driving and our client received a penalty point endorsement which did not trigger the regulations. Our client left the court with his driving licence intact, albeit a little bruised with 5 points being placed thereon.
