This matter called for trial on 13 March 2020 within Dumfries Sheriff Court. The original charge contained an allegation that our client had been riding his motorcycle at an average speed of 117mph whilst undertaking a number of other motor vehicles on the A74(M). The Crown had originally sought to pursue a charge of dangerous driving however the charge was downgraded to careless driving as part of a plea negotiation. A case of this nature would ordinarily and, quite properly, result in a lengthy period of disqualification however our submission that the case could be dealt with by the imposition of penalty points found favour with the court.
