2nd Drink Driving 110ug/22ug Careless Driving Minimum Ban
Our client had a couple of drinks at a work party and drove home in the dark forgetting to put his headlights on. Police were contacted by another motorist.
Upon his arrival at home he consumed more alcohol. The police attended and conducted the usual procedures and breathalysed him. He failed and was taken to the police station where his official reading was taken to be 110ug where the limit is 22ug per 100ml of breath - 5 times the limit. There was also a charge related to his driving without headlights, careless driving.
This was a second drink driving offence within a ten-year period and as such he was subject to the enhanced minimum period of disqualification of 3 years.
We entered into negotiations with the Crown and they agreed to drop the charge of careless driving.
We appeared before the Court and following our mitigation our client was disqualified for the minimum 3 year period and fined the sum of £2,250 but was allowed to keep his vehicle.
