Special Reasons Upheld Lanark JP Court

Our client was pulled over by the police and found to have no valid insurance for the vehicle he was driving at that time.

It came as a shock to him and a shock to his mother who had loaned the vehicle to him.

Both our client and his mother believed that he was insured on their respective policies.

Driving without insurance is a fairly black and white issue and - at the time of driving - our client did not have valid cover.

In such circumstances the appropriate course of action is often to plead guilty and argue that special reasons exist to permit the Court to refrain from endorsing a licence with penalty points.

In this case that is exactly what happened. 

Evidence was led from our client and his mother and the Court decided that there existed special reasons not to endorse our client's licence with penalty points. No points, no fine.

This case was dealt with by our Mr Simpson at Lanark Justice of the Peace Court on 11th December 2019.
