Section 3 Road Traffic Act Cyclist Injured Glasgow

Our client was accused of driving without due care and attention contrary to section 3 of the Road Traffic Act 1988.

Basically, at the big roundabout at Thornwood in Glasgow, our client emerged into traffic having taken all necessary observations and precautions and collided with a cyclist.

The Crown insisted upon a prosecution within the Sheriff Court and our client contacted our office to request representation. 

Having taken our client's position, we advised that a plea of not guilty was appropriate. 

This was simply an accident that occurred due to a low sun temporarily blinding the driver.

The case called for Trial on 4 separate occasions and was dealt with by the Court on the 4th and final occasion. The Crown presented their case and the defence presented their case. At the conclusion of the Trial, the Court agreed that the defence position was to be preferred and accordingly found our client not guilty of the charge of careless driving.

This case was argued by our Mr Simpson on 3rd September 2018 at Glasgow Sheriff Court.
