No Insurance Charge Glasgow Employee Not Guilty

Our client was accused of driving without insurance in Govanhill in Glasgow. He had been delivering parcels on behalf of the company he worked for when he was stopped by police for a routine check. During the course of the check it was revealed that there was no policy of insurance in force.

Employees driving in the course of their employment in a vehicle owned by the company have an expectation that they will be insured to drive the vehicle. In cases where it is revealed that there is no insurance then the employees can avail themselves of the statutory defence in terms of section 143 of the Road Traffic Act 1988. 

It was indeed the statutory defence that our client successfully relied upon and was acquitted of the charge of driving without insurance.

The case initally called for trial on 17th May 2018 and was adjourned to allow the Procurator Fiscal Depute time to make investigations. Needless to say nothing happened and when the matter called again for trial on 10th September 2018 it was agreed that the most expeditious and bodacious way of dealing with the evidence was simply to run the trial. 

Our Mr Simpson successfully presented this case at Glasgow JP Court on 10th September 2018.
