Goods Vehicles (Licensing of Operators) Act 1995

Our client was a plant hire company based in Orkney who fell foul of the Goods Vehicles (Licensing of Operators) Act 1995 and called our office for advice and assistance. The offence related to using a vehicle that was not registered on their Operator's Licence in connection with their business and without the appropriate licence entitlement. 

There were three charges in total. The main charge was a contravention of the Goods Vehicles (Licensing of Operators) Act 1995 sections 2(1)(a) and 5(6)(a) which carries a maximum fine of £10,000 and is taken very seriously by the Courts. 

We spoke at length to the Procurator Fiscal in Kirkwall and agreed that the licence charges would be dropped (carrying up to 6 points each) in exchange for a guilty plea to the Goods Vehicles (Licensing of Operators) Act 1995 charge. 

The Court was addressed in mitigation and the Sheriff was persuaded to impose a fine of only £450 (out of a potential fine of £10,000). 

A fantastic result for the company and the driver kept his licence.

The Long Arm Of The Law

Our client was charged with using his mobile phone to text whilst driving. The police officer was adamant that from a distance of around 10 feet with nothing to obstruct his view he clearly saw our client using his right hand to send a text message. He was unable to see his left hand at all and presumed that it must have been on the steering wheel.
