Dumfries Exceptional Hardship Proof Courier
Our client pleaded guilty to using a mobile phone whilst driving, an offence that carries 6 penalty points. The presence of 6 penalty points already on his driving licence meant that he fell to be disqualified under the 'totting-up' provisions (contained within section 35(1) of the Road Traffic Offenders Act 1988) for a minimum period of 6 months.
Our client owns a courier business and employs 3 members of staff and drives on of the routes himself. Were he to lose his licence for 6 months then he would have had no option but to let one or more of the drivers go and sell one or two of the delivery vans to make ends meet.
Our Mr Simpson attended on 7th July 2021 at Dumfries JP Court and successfully argued that were our client to lose his licence then it would lead to exceptional hardship. Our client was not disqualified and as a result kept his business and his employees kept their jobs.
