Dangerous Driving In Nairn Becomes 4 Penalty Points
Our client was accused of dangerous driving contrary to the Road Traffic Act 1988, Section 2 (as amended).
The allegation was that he had failed to check his mirrors, overtaken when unsafe to do so, causing another vehicle to leave the road, become airborne and crash into a fence.
It was clear that the other driver was at fault to a much greater degree, and we approached the Procurator Fiscal's Office about resolving the case by a plea to the statutory alternative of careless driving (Road Traffic Act 1988, Section 3).
Our client's plea was accepted. Mr Simpson attended at Inverness Sheriff Court on 11th February 2022 and delivered a plea-in-mitigation that found favour with the Sheriff. Our client's licence was endorsed with 4 penalty points, and he was fined £400.
A very fair result in the circumstances.
