Dangerous Driving Guilty Plea Withdrawn 5 Points
Our client had been accused of driving dangerously, colliding with another vehicle and then driving off without leaving his details. The other motorist reported it to the police the following day and our client pleaded guilty to the charge by letter. He was disqualified in the interim and sought legal advice.
We reviewed the case and thought that he had done the wrong thing by pleading guilty to dangerous driving, although the charge of failing to stop was more troublesome. We successfully argued that his plea ought to be withdrawn, and the Court assigned 26th February 2024 for trial.
Our Mr Simpson attended at Glasgow Sheriff Court and the Crown was persuaded to accept a plea of guilty to the lesser charge of careless driving. Following a plea-in-mitigation, our client's licence was endorsed with 5 penalty points and he was fined £425. This, of course, represented a colossal improvement in sentence from his minimum mandatory 12 month ban and extended driving test.
